Familiares de Jorge Luis Cruz Hernández, joven encontrado muerto la madrugada del domingo en la celda de la cárcel municipal de Tangancícuaro y que al siguiente día provocó disturbios y heridos en la plaza principal de ese lugar, no han presentado su queja ante la visitaduría regional de la Comisión Estatal de los Derechos Humanos (CEDH).
Así lo informó Salvador Capilla Eduardo, visitador regional de la CEDH región Zamora, agregó que la causa puede ser que esa gente se sienta atemorizada, “sin embargo, la CEDH estará atenta a cualquier denuncia, señalamiento o difusión que se dé a eventos adicionales a los ya conocidos”.
Añadió, “si es necesario este organismo declarará medidas cautelares, dado que los medios informativos refieren que hay personas que están siendo objeto de hostigamiento. En ese sentido la CEDH está valorando ese tipo de señalamientos para hacer un comunicado a la autoridad a afecto de que cesen, si los hay, esos actos de hostigamiento”.
Dijo, “las medidas cautelares consisten en que la CEDH trate de prevenir un riesgo mayor al desencadenamiento de hechos graves que lesionen los derechos fundamentales de los quejosos, para ello la CEDH emite sugerencias sobre la atención especial que deben tener los mandos superiores en cuanto al actuar de elementos o funcionarios de menor jerarquía y en ese sentido la CEDH está atenta que no haya hostigamiento por parte de funcionarios y servidores públicos”.
Mencionó, “por disposición de la ley, la CEDH tiene facultades para atraer de oficio quejas que sean señaladas en medios de comunicación, de estos obtuvimos los datos para justificar el inicio de una investigación sobre las causas del fallecimiento de esta persona y solicitaremos los informes correspondientes también al ministerio público para conocer las versiones de las personas que estuvieron cerca, así como las declaraciones que rindieron las autoridades en el momento de que rindieron parte”.
Señaló, “ya el presidente de la CEDH, José María Cázares Solórzano, se ha pronunciado respecto a que el personal de la dirección de seguridad pública de Tangancícuaro se ubica en un punto de irregularidad en cuanto a su actuación, dado que están bajo su responsabilidad las personas que ingresan a los lugares de seguridad que tienen a su cargo”.
En ese sentido dijo, “tanto al presidente de Tangancicuaro como al director de seguridad pública en ese municipio les solicitamos un informe de los hechos ocurridos, que ya lo entregaron el pasado miércoles por la tarde. Ahora lo estamos analizando, contiene una narración de los hechos sobre la detección del joven y lo que se derivó posteriormente. Este informe será materia de contrastar con otra información que podamos obtener para ver cual es realmente la situación que deriva estos hechos”.
De esta manera la visitaduria, por instrucciones del presidente de la CEDH, ampliará la investigación de los hechos y recabará la mayor parte de la información. El proceso de investigación tendrá una duración de por lo menos un mes y medio.
Aseveró la CEDH repudia estos hechos, “estamos en contra de este tipo de actos sobre todo cuando se suscitan en el corazón de una población y ponen en riesgo a los ciudadanos”.
Por otra parte añadió que en lo que va del año van 235 quejas en los 34 municipios de esta visitaduria, de las cuales el 60 por ciento son en contra de elementos de seguridad: mando unificado y agentes ministeriales.
Estas quejas, dijo, tienen que ver con detección ilegal, posible tortura en cuanto a la investigación hacia los acusados, detenciones con uso de violencia y multas excesivas. Los municipios con más quejas hacia elementos de seguridad son: Zamora y La Piedad, concluyó.
